Woman Seeking Money Damages For Carnival Fall

The town is among four defendants named in a lawsuit which seeks money damages in connection with an April 2011 incident in which a woman tripped and fell at a firefighters’ carnival held at the Newtown High School grounds.

In the lawsuit dated April 10, Mariel Walters sues Marenna Amusements, LLC, of Orange; Botsford Fire & Rescue Company; Fire Marshal Bill Halstead; and the Town of Newtown.

The plaintiff submitted the case in Waterbury Superior Court. The legal papers list Prospect and Southbury addresses for Ms Walters.

The town received notice of the case on April 24. The town has submitted the matter to its insurance agency, Rose & Kiernan, Inc, and its law firm Cohen & Wolf, PC, for review.

According to the court documents, Ms Walters attended the fire company’s carnival at the high school grounds on April 21, 2011, and fell after she tripped on a bunched-up rubber mat covering electrical wires which ran across a poorly illuminated designated walking area. The fall resulted in physical injuries, the lawsuit states.

The fall resulted from the carelessness and negligence of the defendants, according to the lawsuit.
