HARTFORD (AP) — Connecticut’s Freedom of Information Commission on Friday denied a bid by Newtown officials to postpone a hearing on a request by The Associated Press for records related to the gunman in December’s school shooting.

An attorney for the town asked for a continuance until after the state legislature adjourns on June 5, citing a pending bill that would leave release of some material up to the victims’ families. But the commission said the hearing will take place as scheduled on June 3.

The AP is challenging Newtown’s denial of a request for records involving any emergency calls at the home of gunman Adam Lanza in the years before the shooting. On 12/14, Lanza killed his mother inside their house in Newtown and drove to Sandy Hook Elementary School and killed 26 people, including 20 first grade children, before committing suicide.

An attorney for Newtown, Nathan Zezula, said in February the documents could not be released because they could be used in “a prospective law enforcement action.”

In a letter to the commission on Friday, Mr Zezula said postponing the hearing could prevent a ruling by the commission that potentially would be in conflict with legislation passed days later.

A bill crafted privately by Gov Dannel P. Malloy’s office, the state's top prosecutor and legislative leaders would require the written consent of victims' family members to release any photograph, videotape or digital recording related to the Newtown shooting.
