Police Charge ATV Riders With Simple Trespassing

In response to a complaint about all-terrain vehicles (ATV) being ridden at a local privately owned sand-and-gravel mine, police responded to the area and found five people who were involved in the illegal activity.

Police said they received a complaint about 1:45 pm May 13, informing them that ATVs were in use at the D’Addario Sand & Stone Company Inc’s surface mine at 9 Button Shop Road in Botsford.

Police said they found two adults and three youths under age 16 driving ATVs there. Police said they told the riders that the mine is private property, where the use of such vehicles is prohibited.

The two adults received infraction tickets on charges of simple trespassing. They are Joshua Miller, 26, of Milford, and Dennis Marklewitz, 54, of Woodbury, police said. Simple trespassing carries a $92 fine, which may be appealed in court.

Police said they took no enforcement against the three unidentified youths who were riding ATVs.

In March, in response to continuing complaints from the public about the noise nuisance posed by the use of ATVs and light motorcycles, known as dirt bikes, police announced an enforcement campaign against riders who violate state laws, and focused their efforts at the D’Addario mine.

Police have said that property owners near the mine complain that the use of ATVs there poses a continuing noise nuisance, damaging their quality of life.
