Court Rules On NCLB Issues
HARTFORD (AP) â A federal appeals court says Connecticut can continue pursuing a waiver of the federal No Child Left Behind Law.
The 2nd US Circuit Court of Appeals on Tuesday upheld a lower courtâs dismissal of most of the legal challenge to the federal education reform law, saying they were premature.
But the court says the state can continue pursuing its arguments through administrative channels at the Department of Education.
Connecticut was the first state to challenge the 2002 law when it filed the lawsuit in August 2005, arguing the government failed to provide adequate funding when it required annual standardized tests for students in grades three through eight.
