Town Sues Resident Over Recycling Activities
Legislative Council members July 19 approved a July 12 recommendation from the
selectmen that the town pursue a lawsuit against Samuel Nezvesky of 136
Huntingtown Road concerning an apparent violation of the zoning regulations.
For more than a year, the town has been seeking to have Mr Nezvesky comply
with the zoning regulations which prohibit operating a recycling center as a
business in a residential area.
Zoning Enforcement Officer William Nicholson said July 18 he first notified Mr
Nezvesky in March 1994 that recycling activities conducted by a tenant on the
Nezvesky property violated the zoning regulations. The tenant is listed as
Leonard Coffin.
The recycling activities have been conducted at a low brick building situated
at the front of the Nezvesky property. Mr Nezvesky lives in a house nearby.
Mr Nicholson said he has made repeated attempts to have Mr Nezvesky comply
with the zoning regulations, including having the town's lawyers send him a
letter, plus issuing Mr Nezvesky a cease and desist order to stop the
recycling and remove the accumulated items from around the rental building.
The first selectman also has informed Mr Nezvesky to comply with the zoning
regulations, according to Mr Nicholson.
Mr Nicholson said he's received neighbors' complaints about the situation.
"There's no question, it's a violation of the regulations," he said.
On a trip to the Nezvesky property on July 18, Mr Nicholson said the storage
of miscellaneous items on the property seems to have decreased somewhat in
recent weeks.
