Hemlock Hills Subdivision Rejected
Planning and Zoning Commission (P&Z) members have unanimously rejected Hemlock
Hills, which was a proposed four-lot residential subdivision at Rockywood
Drive and Winesap Road.
P&Z Chairman John DeFilippe and members Thomas Paisley and James Boylan voted
against the proposal at a January 2 P&Z meeting.
Although a relatively small development proposal, P&Z members have discussed
the project at several sessions in light of various technical questions which
have arisen. The applicant is Joseph Dewhirst, and others.
"This is one of the most complicated one's I've seen. I felt like I was a
lawyer on this one," Mr DeFilippe said of the complexities of the application.
A question of who owns a road that would serve the subdivision is very
confusing, he said, adding he has reservations about the development project.
Engineer Charles Spath, representing the applicant, and Town Attorney David
Grogins have done much work in connection with Hemlock Hills, Mr DeFilippe
noted.
"It's still rather a very muddied issue," the chairman added.
Mr Boylan said P&Z members shouldn't approve a subdivision such as Hemlock
Hills until legal questions concerning that road's ownership are resolved.
The three P&Z members then voted against allowing the land to be split into
four lots on the 32-acre site.
