Conservation Panel Sued Over Approval Of Pond Work
A local woman is suing the Conservation Commission over its decision to grant
a Castle Meadow Road couple permission to do pond work on their property.
In a lawsuit filed July 31 in Danbury Superior Court, Susan O. White, of 60
Castle Meadow Road, seeks to have a judge issue a restraining order to prevent
her neighbors, Bruce and Christine Degen of 62 Castle Meadow Road, from doing
the pond work.
In an application filed May 23, the Degens sought permission to restore an
existing pond on their property; construct a sediment basin at the inflow to
the existing pond; and construct a new pond in a wetland area.
On July 9, the Conservation Commission approved the application.
Ms White's land, which holds a pond, lies downstream of the Degen property.
The lawsuit states the commission granted the Degens approval to do pond work,
but failed to impose conditions to ensure the work wouldn't have an adverse
effect on Ms White's land and pond.
The lawsuit states the commission failed to follow the recommendations of the
conservation official concerning the risk of adverse effects on Ms White's
pond due to inadequate erosion and sedimentation controls for the pond work.
The town has an August 26 appearance date on the lawsuit in Danbury Superior
Court.
