Why Obamacare

Is Unconstitutional

To the Editor:

The Supreme Court was created as a final arbiter of our judicial system and with the express job of deciding the “constitutionality” of every law passed by Congress and signed into law — health care is no exception.

Constitutionally, Obamacare was imposed against the principle of “consent of the governed” since some 65 percent of all Americans opposed its passage. Obamacare also undermines “Federalism,” how the federal government operates as a specifically “limited powers” government.

Our Constitution also states: “The powers not granted to the Federal government are reserved for the States and people.” But Obamacare takes those powers and choice away from both states and the people. And it makes our federal government sovereign while giving the president the power of a “Caesar”! This was not the intention of the founders Jefferson, Washington, Madison, John Jay, and the other signers — who worked to diffuse power into three separate but equal branches with no one person or faction having control of any two branches. But the last say was reserved for the people (citizens) via their majority vote.

Note: The words “Equality” and “Freedom” had very different meanings in 1789 when the US Constitution was adopted as our “First Law of the Land.” Equality at that time meant that no man (human) was born the boss of another, and that every man had the right and opportunity to achieve based on their own efforts. What it did not mean nor guarantee was equal access to all resources paid for by your neighbor’s nickel.

In 1789 “Freedom” to our founders meant: Free and secure in your house from attack by foreign intruders, and free to own property, buy, sell, and achieve. It also meant free from coercion by either a king, tyrannical government, or even from coercion by your neighbor.

Obamacare is certainly coercion of the highest effort by Socialist-progressives within our government. Last, but not least, Obamacare changes the federal government from a constitutionally limited government to an unlimited government and from capitalist in nature to socialist without a constitutionally required National Constitutional Convention — thus denying every citizen a vote.

These violated constitutional principles and more are why — Obamacare is unconstitutional.
