A motorist who was involved in a motor vehicle accident with a town snowplow truck in Sandy Hook Center during a snowstorm on the morning of January 28 has informed the town of her intent to sue for money damages.
According to a police report on that incident, a two-vehicle accident involving a town snowplow truck and a SUV occurred about 9:52 am on January 28 near 78 Church Hill Road.
The 2009 heavy-duty Volvo town truck was driven by Jozef Prah IV, 39, of Southbury. The town truck was traveling behind a 1998 Ford Expedition SUV driven by Jeanne Malota, 53, of 3 Erin Lane.
The Ford stopped due to heavy traffic conditions and the Volvo struck the Ford from behind with its snowplow blade. Police verbally warned Prah for following too closely.
In a notice received by the town on February 11, attorney John Parese of New Haven, representing Ms Malota, writes that his client received neck, back, arm, and hand injuries in the accident.
Mr Parese charges that the injuries received by Ms Malota are due to the carelessness and/or negligence of Mr Prah and the Town of Newtown. The lawyer adds that Mr Prah did not drive properly considering the weather conditions at the time and violated state law by driving behind Ms Malota more closely than was reasonable and prudent.
Mr Parese states a lawsuit will be filed against the town over the accident.
