Town Sued Over Park Injury
The town and a manufacturing firm are being sued on behalf of a child who was
injured last September at a party at Dickinson Park.
In a lawsuit filed June 9 in Danbury Superior Court on behalf of Mark Eric
Svenson, Jr, 10, of Georgetown, through his father, Mark Eric Svenson, Sr, the
town and Norco, Inc, a Ridgefield manufacturing firm, are named as defendants.
According to the suit, on June 7, 1996, Norco signed an agreement to pay the
town $325 in rent for use of the Dickinson Park pavilion for a Norco company
picnic.
On September 21, Mark, Jr, was a guest at the company picnic, and while
running up an embankment toward the tennis courts, his left leg struck a
jagged drainage pipe which was protruding from the ground and concealed by
grass, the suit states.
As a result of the injury, Mark, Jr, has a thickness wound of the left shin,
needed a skin graft, had to use a splint and crutch, was permanently
disfigured, and has experienced pain and suffering, according to the suit.
The lawsuit alleges the town and Norco were negligent and careless in the
matter for allowing the jagged pipe to be there, among other reasons.
Mark, Jr, will be compelled to spend a large sum for medical and hospital
care, x-rays, and prescriptions, according to the lawsuit. Also, he will be
impaired in his abilities to carry on and enjoy life's activities, it adds.
Through the lawsuit, the plaintiff seeks damages exceeding $15,000, costs,
interest, the expenses of the lawsuit, and other relief.
Attorney Jennifer Hally of Alan Barry and Associates of Danbury represents the
plaintiff.
The town has a July 1 answer date to respond to the allegations made in the
lawsuit.
