Division Of Land Off Parmalee Hill Approved
In a split vote, P&Z members have approved cutting a 22-acre parcel into two
lots off Parmalee Hill Road.
Attorney Bill Denlinger, representing owner Gary Tannenbaum, told P&Z members
February 19 that the 22-acre parcel's status has not changed in the past 42
years.
When the town adopted zoning regulations 40 years ago, land parcels which
already existed were protected by the "grandfather clause," meaning they were
not subject to all provisions of the new zoning regulations. Mr Tannenbaum's
property falls into that category.
Mr Tannenbaum had applied to the zoning enforcement officer to cut the parcel
into two pieces, but due to technical questions, the matter was referred to
P&Z members for action.
P&Z members then weighed the merits of two apparently contradictory sections
of the zoning regulations to interpret which section takes precedence in
deciding on the application.
Members Heidi Winslow, Daniel Fogliano and James Boylan voted in favor of
cutting the parcel into two lots. Chairman Stephen Koch and Robert Taylor
opposed doing so.
Mr Tannenbaum said he wants to sell one lot and keep the other, plus allow the
Newtown Bridle Lands Association to use some property for horseback riding.
The property has R-2 Residential zoning.
