Furniture Firm Says It Is Complying With The Law

The head of a firm selling Amish furniture at 55 Church Hill Road says it's in

compliance with borough zoning regulations.

But Borough Zoning Enforcement Officer Jean St Jean has issued the Amish

Country Furniture Company an order to cease violations of the borough zoning

regulations stemming from the furniture operation.

"We feel we are in compliance with the laws," Peter Marotz, president of Amish

Country Furniture Company, said Tuesday.

Mr Marotz said that on two occasions he has attempted to obtain application

forms required for such a business but wasn't able to do so.

The furniture sales firm has received a good response from customers, Mr

Marotz said. It started business adjacent to the old railroad station in late

June. The company sells wooden tables, chairs, benches, arbors, playground

equipment, storage sheds and chests.

Mr Marotz said the furniture company has hired Danbury lawyer Ward Mazzucco to

represent its interests.

Because the firm hasn't complied with the town order to cease operations, the

matter has been forwarded to the borough's attorney for action, according to

Ms St Jean.

Ms St Jean has said an inspection of the premises found the site constitutes a

retail shop which includes a permanent outdoor sales area in violation of the

borough zoning regulations. The zoning rules require that permanent sales

areas be wholly enclosed and that no permanent outdoor storage of merchandise

is allowed, according to Ms St Jean.

The company's current use of the premises without a prior review and approval

by the borough sanitarian and the borough zoning enforcement officer, plus the

lack of a zoning permit, violates the regulations, according to Ms St Jean.

The company hasn't provided a plot plan of its business as required by the

regulations, according to Ms St Jean.

"You are to cease all occupancy and use of the premises until you have

received approval from proper borough officials and a zoning permit," Ms St

Jean wrote to the furniture company.
