Oxford Hunter Seeks Accelerated Rehabilitation
The Oxford hunter, who has been charged with criminally negligent homicide and
first-degree reckless endangerment in connection with the November shotgun
death of a Bridgeport hunter in Lower Paugussett State Forest, has applied for
a court program which could erase those charges.
On Tuesday, David M. Alechnowicz, 39, of Oxford, applied for accelerated
rehabilitation in Danbury Superior Court.
State police charged Mr Alechnowicz with the two Class A misdemeanors after
investigating the November 2 shotgun killing of Bridgeport hunter Scott A.
DiBecelle, 28.
First offenders can apply for accelerated rehabilitation. If they are granted
participation in the program by a judge and follow the terms specified by the
judge, the charges are dismissed after a stated period. Accelerated
rehabilitation is a form of probation.
Mr Alechnowicz had entered not guilty pleas to the two charges before seeking
the rehabilitation program.
Mr Alechnowicz was hunting wild turkey, and Mr DiBecelle was hunting coyote.
Mr Alechnowicz allegedly mistook the fully-camouflaged Mr DiBecelle for a
turkey and fired a shotgun blast at him, killing him, according to state
police.
Mr DiBecelle wasn't wearing fluorescent orange clothing as is required by
state hunting regulations.
Mr Alechnowicz didn't identify his target as legal game before firing the
shotgun, resulting in the two charges. Both charges are misdemeanors.
